POPIA Compliance
The Protection of Personal Information Act 4 of 2013 (POPIA) is South Africa's primary data protection law. The Tracking Co (Pty) Ltd is committed to full compliance with POPIA in how we collect, store, and process the personal information of our clients, their employees, and visitors to our website.

The eight conditions for lawful processing
TTC processes personal information in accordance with POPIA's eight conditions for lawful processing:
1. Accountability
TTC takes responsibility for the personal information under its control and ensures that the conditions of POPIA are met when processing personal information.
2. Processing limitation
We collect only the personal information that is necessary for the purpose for which it was collected. Information is collected with the knowledge and consent of the data subject, except where permitted otherwise under POPIA.
3. Purpose specification
Personal information is collected for a specific, explicitly defined, and lawful purpose. We inform data subjects of that purpose at the time of collection. Information is not processed for a secondary purpose incompatible with the original purpose.
4. Further processing limitation
Any further processing of personal information is compatible with the purpose for which it was originally collected. TTC does not sell or share personal information with third parties for their commercial use.
5. Information quality
TTC takes reasonable steps to ensure that personal information is complete, accurate, not misleading, and updated where necessary. Clients may update their account details at any time by contacting us.
6. Openness
TTC maintains a record of all processing activities and notifies data subjects of the personal information we hold. This POPIA notice, our Privacy Policy, and our Cookie Policy form part of our transparency commitment.
7. Security safeguards
TTC implements appropriate technical and organisational security measures to protect personal information against loss, damage, unauthorised destruction, and unlawful access. Measures include TLS encryption, access controls, and South Africa-based data hosting.
8. Data subject participation
Data subjects have the right to request access to their personal information and to request correction or deletion where appropriate. Requests are handled by our Information Officer within the timeframes required by POPIA.
Your rights as a data subject
Under POPIA, you have the right to:
- Access: Request a copy of the personal information TTC holds about you.
- Correction: Request that inaccurate, incomplete, or outdated information be corrected.
- Deletion: Request deletion of your personal information, subject to our legal retention obligations.
- Objection: Object to the processing of your personal information on legitimate grounds.
- Complaints: Lodge a complaint with the Information Regulator of South Africa if you believe your rights have been violated.
Vehicle location data
GPS location data is inherently personal information where it can be linked to an identified individual or vehicle. TTC treats vehicle location data as personal information and processes it exclusively to provide the contracted tracking service.
Fleet operators using TTC to monitor employee vehicles are responsible for ensuring their own POPIA compliance, including obtaining consent from employees where required and maintaining a written employee monitoring policy.
Data breaches
In the event of a personal information security compromise, TTC will notify affected data subjects and the Information Regulator of South Africa as soon as reasonably possible, in accordance with Section 22 of POPIA.
