Terms of Service

These Terms of Service ("Terms") govern your use of GPS tracking hardware purchased from and subscription services provided by The Tracking Co (Pty) Ltd ("TTC", "we", "us"). By purchasing hardware or activating a subscription, you agree to these Terms.

1. Parties

These Terms form an agreement between The Tracking Co (Pty) Ltd (registered in South Africa) and the individual or business entity ("Client", "you") purchasing hardware or subscribing to TTC services.

2. Hardware

GPS tracking hardware purchased from TTC becomes the sole property of the Client upon payment in full. TTC transfers ownership of the physical device at the point of sale. The Client may use, move, resell, or repurpose the hardware as they see fit.

Hardware is sold with a 12-month warranty against manufacturing defects. Damage caused by improper installation, water ingress, physical damage, or tampering is not covered under warranty.

TTC is not responsible for vehicle damage arising from the installation of tracking hardware, whether self-installed or professionally installed by a third party.

3. Subscriptions

TTC subscriptions are provided on a month-to-month or annual basis. There are no minimum contract terms. Clients may cancel at any time on 30 days' notice, with no cancellation fee and no exit penalty.

Monthly subscriptions are billed in advance on the same day each month. Annual subscriptions are billed upfront for 12 months. Subscription fees are non-refundable for periods already paid, except where TTC is unable to provide the service.

TTC reserves the right to suspend or terminate a subscription account for non-payment after 30 days of outstanding balance.

4. Platform access

An active TTC subscription includes full access to the TTC tracking platform — web dashboard, mobile apps, geofencing, alerts, SARS logbooks, sub-accounts, and API access. TTC does not limit features based on subscription tier.

TTC aims for platform availability of 99.5% or greater, excluding scheduled maintenance windows. TTC is not liable for losses arising from platform downtime, cellular network failures, or GPS signal interruption.

5. Acceptable use

You agree to use TTC hardware and services only for lawful purposes. You may not:

  • Track any vehicle without the owner's knowledge and consent
  • Use TTC services for surveillance of individuals in contravention of South African law
  • Attempt to reverse engineer, modify, or tamper with TTC hardware firmware or platform software
  • Share account credentials with parties outside your organisation
  • Use the TTC API in a manner that disrupts the platform for other clients

6. Data and privacy

Vehicle location data generated by your tracking devices remains the property of the Client. TTC processes this data solely to provide the tracking service. See our Privacy Policy for full details.

7. Liability

TTC's liability to the Client for any claim arising under these Terms is limited to the subscription fees paid in the three months preceding the claim. TTC is not liable for indirect, consequential, or special damages including loss of revenue or data.

TTC does not guarantee the recovery of stolen vehicles where the SVR (Stolen Vehicle Recovery) monitoring service is active. Response times depend on third-party law enforcement and recovery networks.

8. Intellectual property

All software, platform interfaces, documentation, and branding associated with TTC remain the intellectual property of The Tracking Co (Pty) Ltd. Clients are granted a limited, non-transferable licence to use the platform for the duration of an active subscription.

9. Changes to the service

TTC reserves the right to update or modify the platform, pricing, and these Terms with 30 days' written notice to active clients. Continued use of the service after notice constitutes acceptance of the updated Terms.

10. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of the Western Cape, South Africa.
