The Tracking Co (Pty) Ltd ("TTC", "we", "us", "our") is committed to protecting the personal information of our clients and website visitors. This Privacy Policy explains what information we collect, how we use it, and your rights under the Protection of Personal Information Act 4 of 2013 (POPIA).

By using our website or services, you agree to the collection and use of information as described in this policy. If you do not agree, please do not use our services.

1. Who we are

The Tracking Co (Pty) Ltd is a GPS vehicle tracking company registered in South Africa and based in Cape Town, Western Cape. We provide GPS tracking hardware, subscription-based monitoring services, and related fleet management tools.

2. What information we collect

We collect the following categories of personal information:

  • Account information: Name, email address, phone number, and business name provided when requesting a quote or creating an account.
  • Vehicle and device data: Vehicle registration numbers, GPS tracker serial numbers (IMEI), and location data generated by installed tracking devices.
  • Location data: Real-time and historical GPS coordinates, trip history, and geofence events for vehicles on your account.
  • Payment information: Billing details processed through our payment provider. TTC does not store full card numbers.
  • Communication records: Emails, WhatsApp messages, and support interactions with the TTC team.
  • Website usage data: Pages visited, time on site, browser type, and IP address, collected via Google Analytics.

3. How we use your information

We use the personal information we collect to:

  • Provision and manage your GPS tracking subscription
  • Respond to quote requests, support queries, and general enquiries
  • Process payments and manage billing
  • Send service-related communications (subscription notices, installation confirmations, platform updates)
  • Improve our platform and services based on usage patterns
  • Comply with legal obligations under South African law

We do not sell, rent, or share your personal information with third parties for marketing purposes.

4. Legal basis for processing

We process your personal information on the following grounds as set out under POPIA:

  • Contract: Processing is necessary to perform the GPS tracking subscription contract.
  • Consent: You have provided consent to receive communications or use optional features.
  • Legitimate interest: We have a legitimate interest in improving our services and preventing fraud.
  • Legal obligation: We process information where required by South African law.

5. Vehicle and location data

GPS location data belongs to the account holder. TTC processes this data solely to provide the tracking service. We do not use vehicle location data for our own commercial purposes, sell it to insurers or data brokers, or share it with third parties except where required by law or court order.

Location data is stored on South Africa-based servers and retained for 90 days following account closure.

6. Data retention

We retain personal information for as long as necessary to provide services and meet legal obligations. Account data is retained for 3 years after account closure. Vehicle location history is retained for 90 days before being permanently deleted.

7. Sharing your information

We share personal information only in the following limited circumstances:

  • Service providers: Third-party suppliers who assist in operating the platform (payment processors, hosting providers, SMS services) under strict confidentiality agreements.
  • Legal requirements: Where required by a court order or South African law enforcement acting under lawful authority.
  • Insurance verification: With your explicit consent, we may confirm to your insurer that a qualifying TTC device is installed in your vehicle.

8. Security

TTC implements appropriate technical and organisational security measures to protect your personal information against unauthorised access, loss, or misuse. Our servers are hosted in South Africa. All data is encrypted in transit using TLS.

No method of electronic transmission or storage is 100% secure. We will notify affected clients in the event of a data breach as required by POPIA.

9. Your rights under POPIA

As a data subject under POPIA, you have the right to:

  • Request access to the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your information (subject to legal retention obligations)
  • Object to the processing of your information
  • Lodge a complaint with the Information Regulator of South Africa
